3、投标人资格要求
投标人应具备的资格或业绩:投标人须按招标文件第一册第四章格式IV-9.资格证明文件格式的要求填写和提交有关资料。
All Bidders shall complete and submit the relevant information in accordance with Form IV-9, Qualification Documents, in Chapter 4 of Volume I of the Bidding Documents.
*1.投标人必须是制造商或者是制造商直接授权的代理商，不接受联合体投标。
1. The Bidder shall be the manufacturer or an agent directly authorised by the manufacturer. Consortium bids shall not be accepted.
如为代理商投标需具备以下条件：
An agent participating in the bid shall meet the following requirements:
*（1）必须提供制造商对本次投标的唯一正式授权书；
(1) A sole formal letter of authorisation issued by the manufacturer for this bid shall be provided.
授权书必须由制造商直接授权，不允许二级授权；授权书中应包括“制造商对产品及售后服务质量负责”的相关内容和制造商联系人及联系方式，并确保制造商联系人能够协调处理项目执行过程中的重要事项。（对于此要求，制造商须在授权书中明确，也可另行出具书面承诺/说明，否则不接受代理投标。）
The letter of authorisation shall be issued directly by the manufacturer; second-tier authorisation is not permitted. It shall state that the manufacturer is responsible for product quality and after-sales service quality, and include the manufacturer's contact person and contact details. The manufacturer's contact person shall be able to coordinate and handle important matters during project execution. The manufacturer shall specify these requirements in the letter of authorisation or provide a separate written undertaking or statement; otherwise, an agent's bid shall not be accepted.
授权书有效期需覆盖质保期。
The validity of the letter of authorization shall cover the warranty period.
*（2）投标人依法登记注册时间距开标日满两年，且距开标日两年内有同类产品至少两个不同年份的销售业绩，需提供证明其销售业绩的合同或订单复印件或用户证明，并由投标人代表签字或盖章。
(2) The Bidder shall have been legally registered for at least two years as of the bid opening date and shall have sales references for similar products in at least two different years within the two years preceding bid opening. Copies of contracts or orders, or user certificates, evidencing such sales references shall be provided and signed or stamped by the Bidder's representative.
*2.投标人需提供制造商在原产地的营业执照(营业登记类证明文件)或经营许可证明文件。
2. The Bidder shall provide the manufacturer's business licence (business registration documentation) or operating permit issued in the country or place of origin.
*3.投标人为境内注册公司的，需具备有效的独立法人资格，需提供有效的营业执照；投标人为境外注册公司的，需提供有效的公司注册登记证明。
3. A Bidder registered within China shall have valid independent legal person status and provide a valid business licence. A Bidder registered outside China shall provide valid company registration documentation.
*4.投标人必须提供开户银行在开标日前三个月内开具的资信证明原件或复印件（由投标人代表签字或盖章），未提交的或提交不符合招标文件要求的，投标将被否决。
4. The Bidder shall provide an original bank reference letter issued by its bank within the three months preceding the bid opening date, or a copy thereof signed or stamped by the Bidder's representative. Failure to submit it, or submission of a document that does not meet the requirements of the Bidding Documents, shall result in rejection of the bid.
*5. 投标人所投本项目气动蝶形开关阀的制造商，近10年内（2016年1月1日至今）应具备同时满足以下要求的类似业绩：
5. The manufacturer of the pneumatic on-off butterfly valves offered for this Project shall have similar references within the past ten years, from 1 January 2016 to the present, that simultaneously satisfy all the following requirements:
*（1）在国内LNG接收站项目具有低温气动蝶阀运行业绩至少3项；
(1) At least three operating references for cryogenic pneumatic butterfly valves in LNG receiving terminal projects in China;
*（2）每个业绩中供货数量不少于10台；
(2) At least 10 valves shall have been supplied under each reference;
*（3）每个业绩包含压力等级不低于CL300、适用温度-196℃、口径不小于40英寸的运行三年及以上的低温气动蝶阀。
(3) Each reference shall include cryogenic pneumatic butterfly valves of not less than Class 300, suitable for -196°C, and not less than 40 inches in size, which have been in operation for at least three years.
投标文件中须提供与本项目供货产地一致的业绩表，业绩表应包括交易数量、产品规格型号及技术参数、用户名称（地点）、签订合同时间、相关联系人员等，还需提供合同复印件（可不含价格）和该合同产品的验收投运合格报告（需盖用户印章），且承诺未发生产品重大质量、安全问题。
The bid shall include a reference list for products with the same place of origin as the goods to be supplied for this Project. The list shall state transaction quantities, product specifications, models and technical parameters, users' names and locations, contract signing dates, and relevant contact persons. Copies of contracts (prices may be omitted) and reports confirming acceptance and successful commissioning of the products under those contracts, stamped by the users, shall also be provided. An undertaking shall be given that no major product quality or safety problems have occurred.
*#6. 信誉要求
6. Reputation requirements
*（1）投标人未被中国石油招标投标网(www.cnpcbidding.com)暂停或取消投标资格。（根据《中国石油天然气集团有限公司投标人失信行为管理办法》的规定，失信积分达到8分时，暂停失信行为人投标资格半年；失信积分达到9分时，暂停失信行为人投标资格一年；失信积分达到10分时，暂停失信行为人投标资格两年。暂停期满后恢复投标资格，有效期内的失信记分继续执行。失信积分超过10分或在暂停期间再次发生失信行为的，取消投标资格三年。）
(1) The Bidder shall not have its bidding qualification suspended or revoked on the China Petroleum Bidding and Tendering Network (www.cnpcbidding.com). Under CNPC's Measures for the Administration of Dishonest Acts of Bidders, a dishonest score of 8 points results in a six-month suspension, 9 points in a one-year suspension, and 10 points in a two-year suspension. Bidding qualification is restored upon expiry of the suspension, while dishonest points that remain valid continue to apply. A score exceeding 10 points, or further dishonest acts during the suspension, results in revocation of bidding qualification for three years.
*（2）投标人未被纳入中石油集团公司供应商、承包商、服务商黑名单（集团公司供应商、承包商、服务商黑名单可在中国石油招标投标网/www.cnpcbidding.com查询）。
(2) The Bidder shall not be included in the CNPC blacklist of suppliers, contractors and service providers, which can be checked on the China Petroleum Bidding and Tendering Network (www.cnpcbidding.com).
*（3）距开标之日前一年内，投标人在中国石油物资有限公司组织的招标活动中对评标结果的无效投诉（包括中石油集团公司机电办处理结果为：不予受理、驳回、维持原评标结果）达到一次及以上的，投标将被否决。
(3) The bid shall be rejected if, during the year preceding the bid opening date, the Bidder has made one or more invalid complaints concerning bid evaluation results in bidding activities organised by China Petroleum Materials Company Limited. Invalid complaints include those for which the CNPC mechanical and electrical products office decided not to accept the complaint, to dismiss it, or to uphold the original evaluation result.
#（4）如投标人有失信分X分，计算评标价时将在投标价的基础上增加X%。失信分以评标委员会现场在对应网站(www.cnpcbidding.com)的查询结果为准。
(4) If the Bidder has a dishonest score of X points, X% of the bid price shall be added when calculating the evaluated bid price. The score shall be determined from the Bid Evaluation Committee's on-site enquiry on the corresponding website (www.cnpcbidding.com).
上述内容以评标委员会现场在对应网站的查询结果为准。
The above shall be subject to the Bid Evaluation Committee's on-site enquiry results on the corresponding websites.
*（5）自2018年1月1日至投标截止日，投标人在中石油质量监督抽查和质量问题通报中（标的物）均未出现质量问题的供应商（复查合格的，可予以接受）；未被国家企业信用信息公示系统（www.gsxt.gov.cn）列入经营异常名录和严重违法失信企事业名单；未被“信用中国”网站（www.creditchina.gov.cn）列入黑名单；未被中国执行信息公开网（http://zxgk.court.gov.cn/）中列入失信被执行人名单。
(5) From 1 January 2018 to the bid submission deadline, the Bidder shall be a supplier with no quality problems concerning the subject goods identified in PetroChina quality supervision spot checks or quality problem notices (a supplier that has passed re-inspection may be accepted); shall not be included in the lists of enterprises with abnormal operations or seriously unlawful and dishonest enterprises and institutions in the National Enterprise Credit Information Publicity System (www.gsxt.gov.cn); shall not be blacklisted on Credit China (www.creditchina.gov.cn); and shall not be included in the list of dishonest persons subject to enforcement on the China Enforcement Information Disclosure website (http://zxgk.court.gov.cn/).
如以上网站不支持中国境外公司查询信用信息，投标人无法提供此项文件，可以将上述内容附书面承诺书。
If the above websites do not support credit information enquiries for companies outside China and the Bidder is therefore unable to provide the relevant documents, the Bidder may submit a written undertaking covering the above matters.
*（6）投标人不存在被责令停产停业、暂扣或者吊销许可证、暂扣或者吊销执照；不存在进入清算程序，或者被宣告破产，或者其他丧失履约能力的情形。须提供由法定代表人或授权代表签署并加盖公章的承诺书。
(6) The Bidder shall not be subject to an order to suspend production or business, suspension or revocation of any permit or business licence, liquidation proceedings, a declaration of bankruptcy, or any other circumstance causing loss of capacity to perform the Contract. An undertaking signed by the legal representative or authorised representative and affixed with the official seal shall be provided.
